Whoever writes the original content owns the copyright for 70 years, or 90 years if it's a corporation. The content cannot be used without permission for commercial purposes. In some cases, it cannot be used period.

An idea, on the other hand, cannot be copyrighted. You could take the original recipe and make substantial changes to the wording - and use a different recipe name - and probably be okay.

I have a dinner planning web site with many recipes. I had to do a bit of research when I started as well. Most of what I read indicated that a recipe per say cannot be copywrited as it is just a list of ingredients. However the name of a recipe or the directions if copied exactly can be. So if you use the same name and same written directions then you would need to obtain permission. I used to enter recipe contests and the rule of thumb was that if a recipe had at least 2 different ingredients or quantities than it qualified as a new recipe. Also from what I have read if you write the directions in your own language or using a different method than that is sufficient to make it a new recipe. Those are the guidelines that I use for myself. That being said I try to give credit whenever possible whether it be the first name and last initial of the person who gave it to me or even "inspired by a recipe in Taste of Home" doing that also allows me to put a text ad for the magazine name.
